By completing checkout and enrolling in service, you (“Customer”) agree to the following terms:

1. DEVICE PURCHASE & OWNERSHIP

1.1 The Water Monitoring Device purchased at checkout is a one-time hardware

purchase.

1.2 Upon purchase, the device becomes the property of the Customer.

1.3 HydroLogix 365 does not retain ownership rights to the device.

1.4 If Customer cancels service, the device remains the property of the Customer and

may be used, transferred, or disposed of at Customer’s discretion.

1.5 HydroLogix 365 may, at its sole discretion and without obligation, offer to repurchase

a device at a discounted rate. Any buy-back offer is not guaranteed.

2. SUBSCRIPTION BILLING & PAYMENT TERMS

2.1 Customer authorizes HydroLogix 365 to charge the payment method provided at checkout for:

  • Monthly monitoring subscription

  • Monitoring + chemical delivery subscription (if selected)

  • Applicable shipping or distance surcharges

2.2 Billing occurs monthly on the same calendar day as the original signup date.

2.3 Subscription charges are billed in advance for the upcoming service period.

2.4 Customer is responsible for maintaining a valid payment method on file.

2.5 If a payment fails, HydroLogix 365 may:

  • Retry the charge

  • Suspend service

  • Withhold shipment of chemicals or cartridges

  • Disable monitoring access until payment is resolved

3. CANCELLATION POLICY

3.1 Customer may cancel service at any time.

3.2 Cancellation requests must be submitted in writing to: [email protected]

3.3 Customer must receive an email acknowledgment confirming cancellation.

3.4 Cancellation must be received prior to the next billing date to avoid the next month’s

charge.

3.5 No refunds are provided for the current billing period once charged.

3.6 If cancellation occurs after a billing date, service will continue through the paid

month.

4. SERVICE DESCRIPTION

4.1 HydroLogix 365 provides:

  • Remote water chemistry monitoring

  • Professional water balance recommendations

  • Text and/or email alerts

  • Optional chemical delivery (local or shipped)

  • Cartridge fulfillment

4.2 HydroLogix 365 does not provide physical cleaning, brushing, vacuuming, skimming, equipment repair, or filtration maintenance unless separately contracted.

5. CUSTOMER RESPONSIBILITIES

5.1 Customer agrees to:

  • Install and maintain the device according to instructions

  • Ensure reliable Wi-Fi connectivity

  • Replace batteries as needed

  • Install cartridges when instructed

  • Follow chemical dosing instructions provided

5.2 Customer agrees to only add chemicals to the pool or spa:

  • In the amount advised

  • At the time advised

  • As directed by HydroLogix 365

5.3 Adding chemicals outside of HydroLogix recommendations may:

  • Invalidate service recommendations

  • Disrupt water balance calculations

  • Jeopardize water safety

  • Void certain service protections

5.4 Customer is responsible for routine pool/spa maintenance including:

  • Brushing

  • Vacuuming

  • Cleaning baskets

  • Ensuring proper circulation

  • Maintaining functional equipment

5.5 Improper maintenance may affect chemical demand and water quality.

6. CHEMICAL HANDLING & LIABILITY

6.1 Pool and spa chemicals are hazardous if misused.

6.2 Customer agrees to:

  • Store chemicals safely

  • Keep away from children and pets

  • Follow all label safety instructions

  • Use proper protective equipment

6.3 HydroLogix 365 provides professional advice based on device data and accepted water chemistry standards.

Customer assumes responsibility for proper chemical application.

6.4 HydroLogix 365 is not liable for:

  • Damage caused by improper chemical handling

  • Failure to follow instructions

  • Failure to maintain proper filtration and circulation

  • Unauthorized chemical additions

7. SHIPPING & DELIVERY (IF APPLICABLE)

7.1 For shipped chemical kits, shipping times may vary.

7.2 HydroLogix 365 is not responsible for carrier delays once packages are in transit.

7.3 For local delivery customers, delivery schedules may vary based on routing and demand.

8. DATA & MONITORING LIMITATIONS

8.1 Monitoring accuracy depends on:

  • Proper installation

  • Functional hardware

  • Wi-Fi connectivity

  • Cartridge condition

8.2 HydroLogix 365 does not guarantee prevention of algae, staining, or water imbalance but provides professional recommendations to minimize risk.

9. LIMITATION OF LIABILITY

9.1 To the fullest extent permitted by law, HydroLogix 365’s total liability shall not exceed the amount paid by Customer in the prior 30 days of service.

9.2 HydroLogix 365 shall not be liable for indirect, incidental, or consequential damages.

10. MODIFICATIONS TO TERMS

HydroLogix 365 may update these terms from time to time. Continued use of service constitutes acceptance of updated terms.

11. ACCEPTANCE OF TERMS

By completing checkout, Customer acknowledges that they have read, understood, and

agree to these terms.
